XHTML5 content served with text/html MIME type shouldn't be validated by
XML parser, because browsers will use HTML parser for it. But
validator.nu allows you to override this. Have you tried to use "Preset"
and "Parser" options.

There is no notation of well-formed HTML5 document. You can have valid
HTML5 document, valid XHTML5 document or well-formed XML which at the
same time might be valid XHTML5 (and if you follow polyglot markup
recommendations it can be valid HTML5 at the same time).

If you want to serve XHTML5 content with "text/html" MIME there is
guideline for this:

http://www.w3.org/TR/html-polyglot/

But there is still one question -- why to serve XML with bad content type.
