They can't patent XAML. There is too much well-documented and publically available prior art. There is an ISO Standard for application languages of that type. Also, given that neither XAML nor XUL acknowledge that standard and assuming that neither group is falsifying their history, XAML, XUL and ISMID pass Tim Berners-Lee's principle of independent invention.
