Sure.  Play only by the rules that work to one's advantage.  This is the 
trend set by HTML and its developers when the web started.  Work to the 
advantage of the application and field it.  Choose very carefully the 
tech your app will interoperate with and ignore the rest.  If you need a 
copyrighted tech or the IP of a consortia or standards group, reverse 
engineer it, change the names, then put it out as a standard or open 
specification.  If that is an open group not interested in proprietary 
tech, go the SML route.  No problem.

They can help themselves anytime they choose. Some will.  There won't 
be a thing anyone can do about that.
