is there any way to turn off an option such that this line will not be added to the top of the XSLT?

At the top of the XSLT or at the top of the result generated by the XSLT
processing?

In the first case, no; we always generate the XML PI (which is also used to
have control on the encoding used to store the stylesheet).
In the second case, you should be able to use the omit-xml-declaration
attribute in the tag; unfortunately, even if support for this
feature should have been available in the current build, Stylus Studio is
not currently handling omit-xml-declaration; this will be fixed in build
47, which will be made available later next week.

As promised, this has been fixed in the latest build 47, now available as
an update to Stylus Studio 3.0
