one way would be to pick up the comments in the apply-templates (but I
made it a for-each here)

     <xsl:for-each select="N|comment()">
            <xsl:sort select="(self::N|following-sibling::N)[1]/@name"/>
 <xsl:copy-of select="."/>
</xsl:for-each>

comments and the following N all get the same sort key and in this case
xslt is stable: they'll come out in the order they went in.
