An XPath expression can give you a node-set, but there are no XPath
expressions that return trees. You could select the set of nodes that
participate in the required tree using an expression such as

id($navid)/ancestor::* | id($navid)/ancestor::*/child::*

but the result would be a node-set not a tree.
