My xslt, when a condition is met is supposed to insert an entity "†" in the output xml. I do not find any thing simlar to xsl:element of xsl:attribute. From the xslt spec I understand we can use character map for this instance. But my client uses xslt 1.0 and saxon 7 and my environment use msxsl 4. Can some one help me.

I think I found a solution, though dont know if it is the right way. Whereever I need "&dagger;" I have coded "<xsl:text disable-output-escaping="yes">&amp;dagger;</xsl:text>"

Yes, that is the code that XSLT 1.0 use; you may want to assign that code to a global variable, so that you can use a shorter $dagger variable reference.
