BTW, your initial param declarations were: <xsl:param name="..."/> <xsl:param name="..."/> exists() will give you true here, because when xsl:param (or xsl:variable) has neither @select or content, its value is the zero-length string. If you can test for both empty sequence of zero-length string, use just <xsl:if test="$param">.
