I'm doing it like this:

<xsl:variable name="level" select="count(ancestor::Menu)"/>
(...)
<xsl:choose>
	<xsl:when test="$level=0">
		<xsl:text>1</xsl:text>   ----> this node is visible
	</xsl:when>

where Menu is your tree_node.
