You are trying to produce output that isn't well-formed XML, and this is one of the few cases that justify disable-output-escaping. Remember, however, that it only works if you use the XSLT serializer to serialize the result tree. In XSLT 2.0 you can define a character-map that maps two otherwise-unused characters to the strings "<%" and "%>" - this still requires you to use an XSLT serializer, but it doesn't impose so many restrictions about using the transformation as a part of a pipeline.
