Why do you suggest that?

That is just a syntax error. If you correct it to

<xsl:when test = "count(BLOCK) > 0">

It is just a long way of writing

 <xsl:when test = "BLOCK">

which is what the original poster had (more or less)

It is ironic that you should say  "Try using COUNT" when the problem is
one of getting the wrong case.
