The simplest way is probably xsl:number

<xsl:variable name="count">
  <xsl:number level="any" count="*"/>
</xsl:variable>

Or you can probably do it with XPath, by adding a condition
[generate-id(ancestor::chapter) = generate-id(current()/ancestor::chapter)]
