but the same question is answerd most days anyway. If you use the 
form with the select expression then you are making a node set
ie a set of nodes in the original document.

in the form without the select expression you are copying nodes from the
original document into a result tree fragment. this is not queryable in
XSLT 1.0 unless you use a node-set() extension function which might be
provided by your system.
