I wonder about this part:

How is that any different from text that contains the symbols used to 
indicate the start of an element or part of an attribute declaration? 
The more general point is that you have to include whole markup units, 
such as an entire CDATA section, element, attribute declaration, or 
whatever, or errors may result.

Undefined namespaces are also an issue.
