<xsl:variable name="firstDiv">
  <xsl copy-of
select="(div[1]|div0[1]|div1[1]|divGen[1])[1]"/>
</xsl:variable>

No that's a result-tree-fragment which isn't much more use than a string
for what you want.

You dont't want a copy-of the first div anyway you want the real thing.

<xsl:variable name="firstDiv"
select="(div[1]|div0[1]|div1[1]|divGen[1])[1]"/>

That variable does contain a node set.
