it is a simple problem but in general such grouping problems are not
simple in XSLT1.

(you might want to look at the grouping examples at Jeni's site)

However if you example input is really representative

Then don't you just want

<xsl:for-each select="name">
<person>
<xsl:copy-of select=".|following-sibling::*[1]"/>
</person>
</xsl:for-each>
