I don't understand why you say that at all. If it's an online validator 
like w3c's or validator.nu then the  mime type seems the right thing to 
use for a default. If you are validating locally then you can pass it to 
an xml or html tool at your choice. If I'm editing in emacs then nxml 
mode will be constantly validating to a relax schema without needing to 
press any button at all, and many other tools can do similar can't they?

a relax schema has already been developed as part of Henri's 
validator.nu effort and that could be converted to XSD if need be 
(possibly with some loss) and then many editing tools could offer 
validation without any webserver being in the loop. In fact the 
situation isn't really much different to that of xhtml is it?
