Hess, It sounds like the non-determinisic restrictions of WXS are a problem here. Since you can't use RELAXNG, another option would be to just live with the <any> wildcard in the WXS schema. Then use Schematron or other processing logic to guarrantee that your 'specified element' is present. WXS, or any one particular schema language, for that matter, can't do everything.
