One approach is that consortia form to manage IP contributions under participation agreements. Otherwise, the bigCo goes it alone. You don't just have MS to contend with. Companies like IBM probably have much larger patent portfolios. What it comes down to now is what they do with the licensing terms. This isn't some new game being played. This is the norm.
