Point 2 is:

   2) frequent use of characters that are explicitly disallowed
        in the URI syntax and thus must be escaped;


I've recently encountered this myself. However, to a large extent 
this comes about from the dependence on XPath which uses [] for 
predicates, < and > for comparisons, and so forth. I don't think this 
could be fixed without losing XPath. Maybe XPath isn't such a good 
fit for XPointer after all.
