For some of these people, they may have the choices they need. 
MACs are still available. 

Topic?  Has XML Run Its Course?  No.  AFAICT, it 
has yet to make it around the track once.  

So effecive choice is the topic?  Ok. 
What are the choices other than XML?

And then there are normal folk that are just buying
off-the-shelf products, who can't specify contracts.

When they have no effective choice ("What OS
do you want today?") there's no accountability,
contract-driven or otherwise.  And when contract
clauses are impractical to enforce, ditto.
