So when I said that `all dtds have the problem' You argue (and I would probably agree) that the problem is in the specification (or lack of) in how DTDs are used in the presence of namespaces. David Megginson argues that we shouldn't be using XML DTD if we are interested in namespaces, which is an argument, but I think I would still be in favour of an interpretation such as you suggest which allows a notion of validation with DTDs that does not break existing systems (they just say that the document doesn't validate) but would allow a class of documents to be DTD-validated by namespace aware systems without fixing prefixes.
