If neither variable is in the scope of the other, as appears to be the case in your example, then it's legal in both XSLT 1.0 and XSLT 2.0.

If one local variable is in the scope of another local variable, then this is permitted in XSLT 2.0 but not in XSLT 1.0.

If I transform with Saxon, everything is OK. If I transform with MSXML I get duplicate variable error.
