  I am a bit intrigued by this expression.  I guess you mean
"not(self::title[..." (note the self axis)?  And if so, I don't see how
this differ from either:

    title[lang($preferredLanguage)] |
    title[lang($2ndPreferredLanguage)]

or:

    title[lang($preferredLanguage) or lang($2ndPreferredLanguage)]
