<xsl:variable name="doc2" select="document('file2.xml')" />

<xsl:template match="node() | @*">
    <xsl:apply-templates select="node() | @*" />

<xsl:template match="*[* and not(*/*)]">
    <xsl:copy-of select="*" />
    <xsl:copy-of select="$doc2//*[not(*)]" />

<xsl:template match="*[not(*)]" />
