I agree with you - there's a problem here. The results you are getting from Saxon and other processors don't match the spec.


There seem to be quite a few tests in the W3C test suite, however, that assume the behaviour you are seeing. So I'm going to raise it as a specification bug to give the WG the opportunity to decide whether it wants to change the spec or the tests.
