It seems to me, that you are saying:

<?xml version="1.0"> is a node in XDM.

but this construct (the XML prolog)

To set the archive record straight, the correct name for that construct is the "XML Declaration". The prologue contains the XML declaration but also contains other constructs:


http://www.w3.org/TR/2008/REC-xml-20081126/#sec-prolog-dtd

The constructs in production "[27] Misc" are part of the data model:

http://www.w3.org/TR/2008/REC-xml-20081126/#NT-Misc

and that is what I was referring to in my post.

is not represented in any form in
the XDM model (so it's discarded while building the XPath tree).

Please correct me if I am wrong.
