What does your question have to do with XSLT? In XML (and XSLT as well,
since XSLT is XML) the > and < have special meaning and delimit the tags
in the source. To use them you must escape them.
The not equal sign in XPath is "!=".
The only languages I know of that use <> as not equal are SQL (some
flavors) and (Visual) Basic, which is are both not on topic here.
