In the definition of the data() function:

http://www.w3.org/TR/xpath-functions/#func-data

it says:

"If the node does not have a typed value an error is raised [err:FOTY0012]."

When would that error occur?  data() seems to work fine on untyped XML...

(using Saxon 9.0.0.3)
