  Yes.  The XSLT serializer can't obvisouly not access output
definitions.  But in the meanwhile, I wonder if this usage is the
correct one in the identity transformation.  Shouldn't use instead:

    <xsl:variable name="format" as="element()">
       <xsl:output/>
    </xsl:variable>
    <xsl:sequence select="saxon:serialize(..., $format)"/>

?
