I don't see anything in
http://www.w3.org/TR/xslt20/#element-namespace
that suggests that xsl:namespace will ever not create a node if its
attributes specify a legal name and URI.

No, there isn't.
But last time I read the data model closely, it said that it was not necessary to implement namespace nodes, if you didn't support the namespace axis.


Now this would seem to be contradicted by xsl:namespace, which seems to require namespace nodes. But if that is only an apparent contradiction (c.f. my suggestion that the wording might be better as saying xsl:namespace produces a namespace binding in the tree), then only two items would be present in the sequence.
