<xsl:copy-of select="text[child::*]" /> that selects the text element, if it has an element child. you want the element children of text so that's <xsl:copy-of select="text/child::*" /> or more simply <xsl:copy-of select="text/*" /> if <text> may have text as well as element children you may want to replace * by node() in either of the above forms.
