But, the colon was a legal part of an XML name, before namespaces came around. Without the namespace declaration, the XML is still "well formed" if the node names contain prefixes and colons. Meaning, that if there's a namespace declaration, the XML must be considered as XML + Namespaces. If there's no namespace declaration, it can be considered as just XML. Not that this is necessarily the cause for processors to act as if the prefix is part of the node name.
