Note that ( concat("[",()!=(),"]"), concat("[",() ne (),"]") ) evaluates to [false] [] so () = () is false and () != () is also false. (This is teh same as in xslt1 and is an automatic consequnce of teh implied existential quantification in the definition of = and !=.
