No, comment nodes cannot have children, so they cannot contain a subtree.
(To put it another way, angle brackets inside a comment are not markup
representing elements and attributes, they are just text.)

In Saxon you can do

<xsl:comment>
  <xsl:value-of select="saxon:serialize($subtree)"/>
</xsl:comment>
