If you just want a copy of the 2nd XML not to apply templates to it then
replace


<xsl:apply-templates
select="document('TreeMenu.xml')//Menu[Menu_K=current()/MenuData]/Menu"
/>

by

<xsl:copy-of
select="document('TreeMenu.xml')//Menu[Menu_K=current()/MenuData]/Menu"
/>


But I am slightly confused as you say you don't want copy-of and in teh
example that you posted, all  MenuData elements are empty, so the filter
Menu_K=current()/MenuData
is never going to be true as no Menu_K elements are empty.
thus you will get no nodes selected for the replacement.
