Yes, but my understanding of the current draft is that you can ask for
us-ascii and no xml-encoding declaration  so the resulting file will
be interpreted as utf8 by a subsequent parser but will use character
refs for any non-ascii characters. (This form being just about the only
form that is safe to send with a mime type of text/xml as anything else
is liable to get mangled by mismatches between encoding rules between
xml and text/* mime type rules.
