don't do that: <xsl:variable name="withname"> <xsl:copy-of select="tblMIMCompanies[contains(translate(@name,$upperCase,$lowerCase),tran slate($name,$upperCase,$lowerCase))'true']"/> </xsl:variable> which makes a result tree fragment not a node list (and is expensive as it really has to copy all the nodes) do <xsl:variable name="withname" select="tblMIMCompanies[contains(translate(@name,$upperCase,$lowerCase),tran slate($name,$upperCase,$lowerCase))'true']"/> which makes a node set is less to type and a lot less expensive to execute.
