<xsl:param name="pos">1</xsl:param> that doesn't make $pos the number 1 it makes it a result tree fragment consisting of a root node with a child text node with string value "1". (_why_ do people keep using xsl:param and xsl:variable with content, this seems to come up every day) If it has the above value then [$pos] is the same as ['1'] which is teh same as [true()] which is not what you want.
