Re: XPath condition supplied as a parameter

your condition param is (most likely) a string so
select="count(child::*[name()=$data_tag][$data_condition])"/>
is legal but [$data_condition] is true just if the supplied string has
non zero length, which may not be your desired meaning.

In common with most languages, xslt does not have expression valued
variables. 

Some systems have an xx:evaluate extension function to evaluate a string
as an xpath expression or in simple cases you can do as in your firs
filter [name()=$data_tag] and just have teh expression parameterised by
the string which you pass in as a parameter.
