any configuration in which the output of XSLT is passed on as some kind
of in memory dom or string to another processor. or any configuration
where the XSLT processor chooses not to implement d-o-e (which is a
conformant option).

disable-output-encoding is a hint (which the processor can ignore) to 
linearise < as < instead of &lt;.

But if the result tree is not linearised but is passed on as a tree to
some other process then this hint will go.

mozilla for example passes the resulting DOM tree straight to its
rendering engine without linearising and re-parsing. so 
a < in character data is a character not the start of markup, whatever
the stylesheet may say about d-o-e.

But in general most interfaces to XSLT that are not simply writing out a
file will have this behaviour.
