<xsl:variable name="foo">
  ...
</xsl:variable>

always creates a result tree fragment.
In order to create any other type of object you use

  <xsl:variable name="foo" select="someXPathExpression"/>

Just get rid of the copy-of and move the select into the xsl:variable.
