You're straying into dynamic XPath expressions here. If you don't want to
use the xx:evaluate() extension, you can do:

<xsl:param name="childElement" select="'*'"/>

<xsl:for-each
   select="element[$childElement!='*][childName=$childElement] |
           element[$childElement='*']">
