This is perhaps not the most beautiful solution, but it might spark a few ideas:

  <xsl:choose>
    <xsl:when test="count(ancestor::em) mod 2 = 1">
      <em>
        <xsl:copy/>
      </em>
    </xsl:when>
    <xsl:otherwise>
      <xsl:copy/>
    </xsl:otherwise>
  </xsl:choose>
</xsl:template>
