doctype copying
DTD constructs, such as DOCTYPE, are not XML elements. (DTD constructs are
metadata, not data.) That's why you can't use <xsl:copy-of/> to copy the
DOCTYPE. Similarly, <xsl:copy-of/> will not copy XML comments or processing
instructions because they are not XML elements, and they are not part of the
XML Infoset. Hope that helps.

copying a root node causes all it's children to be copied.

There are no doctype nodes in the XPath data model. So the doctype is
not seen in the input tree, and so not copied.
