As Mike makes (more or less) clear in his book, that is describing some experimental features that may or may not make it into XSLT. Having said that, XSLT 1.1's xsl:script is/was a top level element and this was used in a template, so I don't think the original poster was using xslt 1.1. I suspect that it wasn't XSL at all but the transformation language of IE5.
