Yes, but in text()[count(action)+1] the context node for the predicate
is the text node, which has obviously no children.
I think it should be
  text()[count(current()/action)+1]

Another suggestion:
  action[last()]/following-sibling::text()
ie the text sibling(s) after the last action element.
