No. The XML declaration is not a PI - though it looks like one, to be
sure - and in fact "XML documents should begin with an XML declaration
which specifies the version of XML being used." 
(http://www.w3.org/TR/REC-xml#sec-prolog-dtd) - MSXML3 is doing the
right thing here.
