Your stylesheet appears to be trying to convert XHTML to HTML. HTML doesn't have a motion of namespaces so I'm not sure why you are doing this: <xsl:element name="{local-name()}" namespace="http://www.w3.org/1999/xhtml"> shouldn't you just be doing this: <xsl:element name="{local-name()}"> However it is clear why you get the output shown, You have removed (commented out) the DTD so now, as there is no namespace declaration in the file, and the DTD isn't being read, the html element is in no namespace so <xsl:template match="/html:html"> will not match, as that looks for elements in the xhtml namespace. You'd need <xsl:template match="/html"> to match on an unnamespaced html element.
