If my path is rooted at the document (/foo/...), I thought of the following
(the syntax isn't quite right, but hopefully its clear):

/foo//bar[ !ancestor::*[name()!='foo' and name()!='a' and name()!='b' ]]

But that won't work if my path is a relative one...
